Commissionerfor Oaths

A Commissioner for Oaths is an officer appointed by the Minister of Justice of Québec, authorized to administer oaths, solemn affirmations and declarations where required or permitted by law. A Commissioner for Oaths is not a lawyer and does not provide legal advice.

Affidavits, statutory declarations, solemn declarations, sworn statements, court and tribunal documents, administrative documents, corporate documentation, government forms, insurance declarations and financial declarations, among others, where an oath or affirmation is required or permitted by law.

Where legally permissible under applicable Québec law, eligible declarations and documents may be administered by secure videoconference. The specific eligibility of a document for a virtual appointment depends on the applicable legislation and the nature of the document.

Valid government-issued photo identification is required at every appointment. Acceptable forms of identification include a Canadian passport, a provincial driver's licence or a permanent resident card. Additional identification may be required depending on the nature of the document.

Most appointments are completed in fifteen to thirty minutes. The duration depends on the number of documents to be executed, the number of signatories, and whether any additional administrative requirements apply.

The statutory fee prescribed under Québec law for administering an oath or solemn affirmation is up to $5.00 per oath or affirmation. This fee applies solely to the administration of the oath or affirmation itself. Separate professional service fees may apply and will be disclosed and confirmed in advance.

A Commissioner for Oaths does not certify true copies of documents, authenticate official documents for use in other jurisdictions, provide legal advice, draft legal documents, or perform notarial services reserved exclusively to Québec Notaries.
